USER AGREEMENT ("Agreement")

ACCEPTANCE OF TERMS THROUGH USE

This document is a legal Agreement between you, and Open Fences, LLC. Please read this Agreement carefully. By using www.landbrokermls.com you accept the terms and conditions of this Agreement.

1. COPYRIGHT
The www.landbrokermls.com web site is owned by the Open Fences, LLC. and is protected by international copyright laws. Open Fences, LLC. reserves all rights with respect to the www.landbrokermls.com API, Graphics, Animations, Marketing tools, Search Engines and other documentation under all applicable laws for the protection of proprietary information, including, but not limited to, trade secrets, copyrights, trademarks and patents. All Rights Reserved.

2. LICENSE
LandBrokerMLS.com is a free real estate source for the end user. An end user is defined as an Internet user whose interest in land is merely the need to locate or find land or land related services. LandBrokerMLS.com is a paid service for Brokers and agents as well as advertisers. Therefore, you may not copy, transfer or use any graphics, text or other data viewed under this site. Also, you may not copy source views or attempt to reverse engineer this Internet application.

3. USAGE
Open Fences, LLC. grants you rights to use LandBrokerMLS.com to list a property upon signup. Open Fences, LLC. also grants Internet users the rights to search our databases locate land, businesses and / or brokers / agents only. Any other use of LandBrokerMLS.com is prohibited and all violators will be logged and prosecuted to the fullest extent of the law. Open Fences has the right to allow all property listings to be accessed by other sources as it chooses so long as the the property details are preserved, listing broker's name is provided, and may or may not include broker contact information. Brokers understand their listings will be included in a nationwide MLS and listing information will be available for display on other broker's websites through LandBrokerMLS.com's Land Data Exchange (LDX).

4. TERMINATION
This license to use LandBrokerMLS.com is effective until terminated. You may terminate this license at any time by leaving this site and closing your account if you have already created one. In addition, Open Fences will issue a prorated refund on the remaining membership term. This license will terminate automatically, without notice from Open Fences, LLC. if you fail to comply with this Agreement.

5. LIMITED WARRANTY
LandBrokerMLS.com is supplied "AS IS". Open Fences, LLC. disclaims all warranties, expressed or implied, including, without limitation, the warranties of merchantability and of fitness for any purpose. The user must assume the entire risk of using the LandBrokerMLS.com web site.

6. NO LIABILITY FOR CONSEQUENTIAL DAMAGES
Open Fences, LLC. assumes no liability for damages, direct or consequential, which may result from the use of the LandBrokerMLS.com, even if Open Fences, LLC. has been advised of the possibility of such damages.
